Online Platform - Terms of Use and Privacy Statement
Deakin University ABN 56 721 584 203 of 1 Gheringhap Street, Geelong, Vic, 3220, Australia (Deakin) is conducting health research using Deakin's DepressionASSIST(Online Platform) for the purposes of health research (the Research).
To participate in the Research (as a participant) you agree to access and use the Online Platform in accordance with these Terms of Use and any other terms, conditions or directions provided by us.
Software Use and Licence
Deakin retains all right, title and interest in and to any and all intellectual property rights subsisting in the Online Platform and any and all modifications, revisions, changes, or improvements to the Online Platform. Deakin owns all new intellectual property rights generated in the course of using the Online Platform.
Deakin grants you a non-exclusive and non-transferrable licence (with no right to sublicense) to use the Online Platform for the purposes of participating in the Research.
As an end user, you will otherwise retain no interest, right or title to the Online Platform, any third-party software incorporated into the Online Platform or any other system used to deliver the Online Platform.
As a participant in the Research, you assign to Deakin all right, title and interest in the research results generated by your use of the Online Platform, excluding your Personal Information governed by the Privacy Statement and Privacy Policy, discussed below.
Privacy Statement
By accessing the Online Platform, Deakin will collect personal information about you for the purpose of the Research and reporting anonymised Research results in scientific publications and presentations.
Personal information collected by the Online Platform may include, but is not limited to your name, email address, password for the online platform, and IP address. If you do not wish to provide this personal information, you will not be able to use the Online Platform and participate in the Research.
The Online Platform will also track your clicks, content accessed, content and images input and uploaded, and time of day as well as time spent accessing particular pages and content. This data may be also used in the furtherance of other research projects on a de-identified basis.
The Online Platform uses third-party service to fulfil its purpose, including:
GreenAnt data storage and analytics services (https://www.greenant.net/privacy/); and
links to third-party websites that we cannot control.
Your information will not be shared to these third-party services for any purpose other than those described above. We will not sell any of your personal information.
We cannot assume responsibility for:
the content or practices of any web-browser, email client, software provider other device you use to access the Online Platform; and
the content or practices of third-party websites.
If you are concerned, we advise you to review the privacy policies of the services listed above and the privacy policies of any third-party services, sites or devices.
Deakin manages the personal information it holds - including requests for access - in accordance with the Privacy and Data Protection Act 2014 (Vic), Deakin's Privacy Policy and any prior written consent provided to Deakin for this Research.
While Deakin stores the data it collects in Victoria, Deakin's service providers may access that data from outside Victoria and outside Australia. Where this occurs, Deakin has contracted with those providers to ensure:
any personal information is provided by Deakin only for the performance of the contracted service;
the service provider will have in place administrative and technical measures to keep the personal information secure and protect the personal information from unauthorised access, use, disclosure, modification or deletion; and
personal information is disclosed only to the extent required by a provider to provide a contracted service.
The terms of this part 2, Privacy, is in addition to and does in no way limit any written consent you give to participate in this Research that you, a member of your family, your guardian or any other person has already provided to Deakin.

Warranties and liability
To the best of our knowledge, the Online Platform does not include any misappropriated intellectual property or infringe any intellectual property rights of a third party. We expressly exclude any warranty that the Online Platform will be error-free or capable of continuous operation.
We are not liable for non-conformity of any part of the Online Platform where the non-conformity is caused by use of the Online Platform for any purpose other than the Research or any other reasonably related purpose.
We will not be liable to you or any member of your family for any loss (including, without limitation, any damage to property), damage, cost, expense, personal injury, illness or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with the Online Platform, to the maximum extent allowable by law.
Any advice, recommendations and information provided by the Online Platform are of a general nature and not tailored to your individual circumstances. If you have concerns about the state of your mental or physical health or that of any member of your family in any way, from your use of Online Platform or otherwise, please consult a registered health practitioner as soon as possible.
Miscellaneous
These Terms of Use constitute the entire agreement between you and Deakin as to their subject matter and may only be varied in writing signed by you and Deakin.
You may not assign or transfer any of your rights or obligations under these Terms of Use without Deakin's prior written consent.
Part or all of any clause of these Terms of Use that is illegal or unenforceable in any jurisdiction will be severed and the remaining provisions will continue in force.
These Terms of Use are governed by the laws of the State of Victoria, Australia, and the parties submit to the exclusive jurisdiction of the courts of that State in respect of any dispute under these Terms of Use.
